International Investigators Hear From People Who Have Experienced Homelessness

On March 1, the Spatial Justice Community Collaborative class under the direction of UCLA Luskin Professor Ananya Roy joined with the Promise Institute for Human Rights to host the Inter-American Commission on Human Rights and Soledad García Muñoz, special rapporteur on economic, social, cultural and environmental rights. During a presentation that built on research by the UCLA Luskin Institute on Inequality and Democracy, six presenters affiliated with the class talked about their lived experiences, including the time some had spent living in homeless encampments such as one at Echo Park Lake that had been forcibly cleared by law enforcement two years earlier. García Muñoz and her colleagues, Daniel Norona and Paul Mora, then asked questions and spoke about the importance of such interactions to their mission to investigate allegations of human rights throughout the Americas. García Muñoz also viewed an altar that was built by the class to honor the large number of preventable deaths of unhoused residents in Los Angeles. And she engaged in conversation with panelists such as Jennifer Blake, whose artwork focuses on uplifting people like herself who have experienced homelessness.

Yaroslavsky on Standing Up Against Hate

Zev Yaroslavsky, director of the Los Angeles Initiative at UCLA Luskin, spoke with KPCC’s “AirTalk” about a new report on hate crimes in Los Angeles County. In 2021, the number of reported hate crimes rose from 641 to 786, the highest since 2002, according to the county’s Commission on Human Relations. The most targeted groups were the Black, LGBTQ, Latino and Jewish communities. Yaroslavsky said public officials must use their positions of authority to stand up against hate. “You speak up. You make it socially unacceptable to behave in bigoted ways, not just antisemitism but racism, sexism, homophobia,” said Yaroslavsky, who served as a Los Angeles councilman and supervisor for 40 years. “One of the most important roles an elected official can perform is to set the bar high when it comes to human relations, and to give no quarter to anyone who advocates persecution, who traffics in bigotry and antisemitic or racist tropes.”


 

Vestal on Barriers to Addressing Homelessness

Assistant Professor of Urban Planning Mark Vestal spoke to LAist about Section 8, a federal program that subsidizes housing for low-income individuals and families, the elderly and disabled. This program allows individuals experiencing homelessness to secure housing through vouchers. However, Vestal noted that about 50% of the people who get vouchers still can’t find housing. Landlords are incentivized to accept housing vouchers when they are in communities in decline and they are unable to get market-rate rent, but the incentive disappears when neighborhoods start to gentrify. “Landlords can discriminate against voucher holders and they have complete discretion,” Vestal explained. Furthermore, once an individual finds an apartment, it can still take a long time for the housing voucher to be approved. Vestal concluded that unhoused people have ideas about how they want to live with belongings and social space, and we should have a housing system that respects their needs and wants.


Endowed Chair Awarded in Honor of Former Dean Gilliam New chair in social justice will benefit the research of Manisha Shah, a professor whose global policy focus includes child health and intimate partner violence

The Luskin School of Public Affairs presented its newest endowed chair to Professor Manisha Shah on Nov. 9 with the chair’s namesake, former Dean Frank Gilliam, and its benefactors, Meyer and Renee Luskin, in attendance.

The Franklin D. Gilliam, Jr. Chair in Social Justice, which was created by the Luskins as part of their naming gift to the Luskin School in 2011, will provide financial support for Shah’s research throughout a five-year term as holder of the chair. She is a professor of public policy who joined the UCLA Luskin faculty in 2013.

Gilliam’s long tenure at UCLA as a professor and then dean ended in 2015 when he became the chancellor of the University of North Carolina at Greensboro. He said it is an honor to have his name attached to an award focusing on social justice.

“I am extremely humbled and honored that the Luskins have created an endowed professorship in my name,” Gilliam told an audience of about 75 invited guests who assembled on the festively redecorated third-floor rooftop of the Public Affairs Building.

The social justice focus of the endowment was particularly meaningful for Gilliam. “These are issues I’ve spent my entire professional and personal life working on and I continue to do so today,” he said.

As the holder of the endowed chair, Shah said she plans to further her attempts to understand the barriers that prevent women and girls around the world from living their best lives, an issue that led her to found the Global Lab for Research in Action at UCLA in 2019.

“What do we do at the lab? Through a gender lens, we focus on hard-to-reach populations, understudied populations, and we look at groups like adolescents and sex workers and low-income women. We study critical issues related to child health and intimate partner violence and sexual health,” Shah said during her remarks. “Ultimately, the idea is that we’d like to shift public conversation and eventually shift some of the social norms.”

Gilliam, who first hired Shah to join the faculty at UCLA, expressed pride and excitement that she had been chosen as the inaugural holder of the chair in his name.

“She is a remarkable person, a remarkable intellect,” Gilliam said. “Her work is so important. It spans disciplines like economics and public policy and really social welfare, quite frankly. She focuses on the most understudied topics and the most overlooked populations. … This is big stuff.”

Current Dean Gary Segura noted the pivotal role that Gilliam played in bringing social justice to the forefront during his time as dean, shaping the sometimes-disparate disciplines within the Luskin School into a unifying vision.

“Frank Gilliam, perhaps more than any single other leader in the School’s history, shaped the social justice mission and identity of the Luskin School of Public Affairs,” Segura said.

In his remarks, Meyer Luskin said his observations of Gilliam’s leadership and priorities helped lead him toward making the $50 million naming gift to the Luskin School a decade earlier.

“I saw dedication, courage, morality and ethics, empathy, much resourcefulness, strength and kindness, intelligence, hard-working, visionary, loyalty, a great sense of humor, and a man most devotedly committed to justice and equality,” he said.

Segura thanked the Luskins for their foresight and generosity in endowing the new chair, plus three other previously awarded chairs benefitting professors at UCLA Luskin.

Gilliam said their selflessness is well-represented among people associated with the professions of social work, public affairs and urban planning that are taught at the Luskin School.

“The people who work in your area often go unnoticed. They don’t do it for the fame, they don’t do it for the fortune,” he said. “This is hard work, it’s complicated work. It’s real work … on the ground, dealing with real-world policy problems that affect the society.”

Gilliam surveyed the crowd of family, friends and former colleagues who had gathered to celebrate Shah and recognize an endowment that will forever carry his name. Ultimately, said the former professor, dean and current chancellor, it’s about passion for the cause, the mission, embodied for Gilliam in the words spoken by Meyer Luskin when they first met:

“My goal in life is to make the world a better place.”

Armenta on Repercussions of ICE Collaboration Programs

Associate Professor of Urban Planning Amada Armenta spoke to the Los Angeles Times about increasing pressure to reform the U.S. Immigration and Customs Enforcement agency (ICE), which has for years been criticized for its treatment of immigrants in detention. The implementation of any changes will fall under the responsibilities of the new director, nominated by President Joe Biden. Some advocates have demanded improved conditions in detention centers as well as the scaling back of programs such as 287(g), which allows for collaboration between ICE and local law enforcement. While ICE says the local collaboration programs are meant to promote public safety, the result is that many undocumented immigrants are reluctant to report crimes to law enforcement out of fear that they will be expelled from the country. Armenta argued for doing away with the collaboration programs altogether. When immigrants are afraid to engage with law enforcement, “that’s bad for all of us,” she said.


Water Should Be Affordable for All, Pierce Says

Gregory Pierce, an adjunct assistant professor of urban planning, spoke to KQED about his concerns about equity in the attempt to provide clean drinking water to California cities. In response to the drought, Marin County is considering building a desalination plant and pipeline that would draw in water from the San Francisco Bay. After studying the impact that desalination could have on low-income and marginalized communities, Pierce concluded that “desalination can be part of the answer [in California], but it’s not the best answer right now or in the near term.” Using desalination to produce drinking water from seawater fails to encourage people to adopt habits that conserve freshwater resources, and it can also negatively impact the environment. Instead, Pierce argued that recycling water or fixing infrastructure is a faster and less-expensive solution than constructing a desalination plant. “As a concept, desalination sounds good, but it’s not usually delivered equitably,” said Pierce, co-director of the Luskin Center for Innovation at UCLA. “If water is truly a human right, it should be affordable to everyone.”

Human Rights Over Property Rights, Vestal Says

The Los Angeles Times spoke to Assistant Professor of Urban Planning Mark Vestal for a column about the growing issue of homelessness in Los Angeles. Experts estimate that there are at least 60,000 people experiencing homelessness in Los Angeles and as many as 365,000 renting households on the brink of eviction. While most Angelenos agree that homelessness is a pressing issue, they disagree on whether it is a property rights issue or a human rights issue, which makes it difficult to find a solution. “The history of homelessness testifies to the futility of trying to find solutions that average these two perspectives,” Vestal said. Enforcing property rights on people experiencing homelessness only creates more obstacles to ending homelessness. “You can’t just criminalize a condition that people can’t cure,” Vestal said. “These problems that we have created — they are all intimately tied up with the good things we thought we were making of our society.”


UCLA Research Finds U.S. Lags Behind Other Nations in Limiting Detention of Migrant Children

The COVID-19 pandemic has amplified calls to end the detention of migrant children, as cases surge among children held in crowded conditions. Yet immigration detention’s threats to the fundamental rights of children did not begin with the current public health crisis. Unlike nearly three-quarters of high-income countries, the U.S. has no laws specifically limiting the detention of accompanied migrant and asylum-seeking children, according to a new study by the UCLA Fielding School of Public Health’s WORLD Policy Analysis Center (WORLD). Moreover, the U.S. offers minimal legal protection for unaccompanied minors, and for children who are detained, and the U.S. has no legal guarantees of access to adequate health care or education. “The U.S. lags behind when it comes to protecting the most fundamental rights of migrant children,” said Jody Heymann, a UCLA distinguished professor of public health, public policy and medicine who serves as director of WORLD. International treaties are clear that detaining children based on citizenship is a violation of human rights law. Heymann and her research team systematically coded legal restrictions on detention of child migrants in the 150 most populous United Nations-member countries, as well as literature on the costs and benefits of varying approaches to keeping such children safe and under responsible oversight. Their study, published in the International Journal of Human Rights, found that while the U.S. falls behind other high-income nations, gaps in legal protections persist across the board. “These longstanding gaps in the law have left countless children vulnerable to grave health risks and human rights violations,” Heymann said.


 

Cohen Highlights Trauma of Involuntary Commitments

Research by Social Welfare Professor David Cohen was cited in a Cut article about the legal consequences for individuals deemed mentally ill in the United States. Britney Spears’ conservatorship has highlighted the way that psychiatric diagnoses can be used to strip individuals of their rights to voting, medical decision-making, financial decisions and more. Cohen’s research shows that patient privacy laws and lack of data collection pertaining to human rights violations of the mentally ill make it difficult to estimate exactly how many people have experienced involuntary commitment. Last year, a study by Cohen found that involuntary commitments over the previous decade outpaced population growth three to one, and another estimate extrapolated that over 1 million Americans a year are involuntarily committed. “This is the most controversial intervention in mental health — you’re deprived of liberty, can be traumatized and then stigmatized — yet no one could tell how often it happens in the United States,” Cohen said.


UCLA Researchers Evaluate Efforts to Curb Trade of Conflict Minerals Report finds ‘meaningful progress’ over past decade, but issues including child labor violations persist

Over the past decade, the U.S. and other nations have implemented programs intended to monitor and mitigate human rights abuses and armed conflict related to mining operations around the world.

A new report co-authored by UCLA researchers has found that those so-called due diligence programs have fostered “meaningful progress” in the Democratic Republic of Congo, one of the countries targeted by the initiatives. But child labor and other violations are still taking place.

Tin, tantalum and tungsten are commonly used in computers and cell phones and a wide array of other electronics. In some countries like the DRC, those materials are designated as “conflict minerals” because the areas in which they’re mined are affected by armed violence — and in some cases, the violence is related to mining operations.

Researchers collected data in 2019 from 104 mine sites, as well as 1,054 households and 1,000 people living in villages around those mine sites, in the provinces of South Kivu and Maniema. They found that areas with due diligence programs see less interference by the armed forces of the Democratic Republic of Congo. Compared to areas without due diligence programs, more than 50% fewer mines in areas served by due diligence programs reported a military presence or improper taxation by soldiers.

The study also found that, in villages near the mines served by those programs, the number of households reporting a military presence was 27% lower than in villages without the programs.

However, the analysis also revealed that mines in the areas covered by the diligence programs do not have significantly lower rates of child labor than those outside of the programs’ purview. Some child labor was reported at roughly one-third of mines, whether they were covered by the programs or not.

“We uncovered reasons to applaud these programs, but also room for improvement, particularly with respect to child labor,” said Darin Christensen, co-author of the study and an assistant professor of public policy at the UCLA Luskin School of Public Affairs. “Unsurprisingly, the due diligence program is not a panacea — it reduces important risks associated with mining in the eastern Congo but does not eradicate all harms.

“In better isolating its impacts, we hope to clarify where further efforts are needed to promote sustainable livelihoods and human security in mining regions.”

Christensen is the co-founder (with UCLA professors Graeme Blair and Michael Ross) of the UCLA-based Project on Resources and Governance, which led the study’s research design and analysis. The report’s other contributors are the International Peace Information Service, a Belgian research institute; Sub-Saharan Field Research & Consulting Services, a Kenyan research agency; and Ulula, a Canadian software and analytics provider.

International efforts to mitigate or eliminate the negative impacts of conflict minerals have focused on keeping the minerals out of global supply chains. The aim is to break the link between mining and conflict by identifying and boycotting suppliers who contribute, willingly or unwillingly, to armed groups or human rights abuses, according to the report.

This strategy is reflected in regulatory efforts such as the 2010 Dodd-Frank Act in the U.S. and the European Union’s more recent Regulation on Conflict Minerals. Those policies require U.S. and European companies that source certain minerals from conflict-affected areas, like eastern Congo, to conduct due diligence around the production and processing of minerals to verify that suppliers respect human rights and do not contribute to conflict.

But more than a decade after Dodd-Frank, there had been scant research on whether due diligence programs are improving economic and security conditions.

The report also found that areas covered by due diligence programs report a greater presence of government regulators.

Researchers found that the proportion of households reporting tax collection and services provided by the government regulators who are responsible for monitoring the mining sector was 58% higher in areas served by the programs than in those that aren’t. However, when households were asked whether they felt secure, there was no statistical difference in responses between those in areas served by the program and those that were not.
